Immigration and Right to Rent: changes are coming - are you prepared?

The Governement announced that it is rolling out Right to Rent across England from February 1st 2016.

All private landlords in England will need to carry out right to rent checks on all new prospective tenants and occupiers, to check they have the right to live in the UK.
 
From 1 February 2016, right-to-rent checks will be required in England if you:

  • Are a private landlord
  • Take in a lodger
  • Are a landlord or tenant sub-letting a property
  • Are an agent appointed by a landlord to make right-to-rent checks

To comply with the regulations landlords will need to:

  1. Check adult tenant(s) will live in the property as their only or main home
  2. Ask tenant(s) for the original document(s) that show they have the right to be in the UK
  3. Check the documents are valid with the tenant present
  4. Make and keep copies of the documents and record the date you made the check  


The Government is now updating its guidance document for landlords. See the DRAFT Code of Practice which will tell you

  • if your property is affected
  • if any exemptions apply
  • how to carry out a right to rent check
  • what documents individuals can show you as evidence of their right to rent
  • when and how to request a right to rent check from the Home Office
  • how to avoid unlawful discrimination when conducting immigration right to rent checks
